1. Agreement and definitions

These Terms and Conditions govern the legal relationship between Studio Benjamin van der Zalm, trading as AgroForest Designer (the “Service”), and each natural or legal person who registers for or uses the Service (the “User”). By creating an account or using the Service, the User agrees to these terms.

AgroForest Designer is a web-based software service for creating agroforestry designs with plant-management, planning, analysis, visualisation, sharing, and export tools.

Key definitions

Service
The AgroForest Designer website and application, including the features made available through it.
Subscription
A free or paid plan with defined features and usage limits.
User Data
Information and content entered into the Service, including projects, planting plans, recipes, custom cultivars, notes, and annotations.

2. Registration and accounts

Account requirements

  • The User must be at least 18 years old.
  • The User must provide complete and accurate registration information and keep it current.
  • The User is responsible for safeguarding account credentials and for activity performed through the account.
  • The User must notify AgroForest Designer promptly if unauthorised account access is suspected.

Multiple accounts

A User may create more than one account for legitimate use by the same person or organisation. Multiple accounts may not be used to evade plan limits, commit fraud, or otherwise violate these terms.

3. Subscriptions, billing, and cancellation

Payment and automatic renewal

Payments for paid subscriptions are processed by Stripe. The User must provide valid payment information. A paid subscription renews automatically for the billing period shown at checkout unless it is cancelled before the renewal date.

The User can manage or cancel a Stripe-managed subscription through the account’s billing settings. When cancellation is scheduled for the end of a billing period, paid access remains available until the date shown in the account. Any other cancellation takes effect as confirmed by Stripe and displayed in the account.

Cancellation, withdrawal, and refunds

Cancellation does not create an automatic refund. Consumer Users may have mandatory cancellation or withdrawal rights, including a 14-day withdrawal period for certain distance contracts. The availability and consequences of those rights depend on the circumstances and applicable law. A withdrawal request, payment question, complaint, or refund request can be sent to contact@agroforestdesigner.com. Nothing in these terms limits mandatory consumer rights.

4. Features, limits, and User Data

Usage limits and plan changes

Each plan has limits on projects, recipes, and custom cultivars. When a limit is reached, the User cannot create additional items in that category. If the User moves to a plan with lower limits, work above the active limits may be frozen and remain visible but read-only until capacity becomes available again.

Ownership and service licence

The User retains ownership of the projects, planting plans, recipes, custom cultivars, notes, and other original content they create in the Service. The User grants AgroForest Designer the limited permission required to host, process, display, back up, and transmit that content to provide and secure the Service.

Plant information is compiled from external sources. Individual data and source material remain subject to their applicable rights and licences. Attribution or source information displayed by the Service must be preserved. Except where applicable law or a source licence permits it, the User may not copy, scrape, or redistribute the database as a whole.

Sharing and community content

When the User deliberately shares content through a public or controlled link, community post, or other sharing feature, the User grants AgroForest Designer permission to display and transmit that content to the selected audience for as long as the sharing remains active. The User is responsible for having the rights needed to share the content. AgroForest Designer may restrict or remove shared content where reasonably necessary to enforce these terms, protect users or systems, or comply with law.

Export

Users of Pro and Max can download portable project backups. Plans without Backup and data export may still include specific in-product exports where those exports are listed in the plan comparison.

Retention after cancellation or account deletion

Subscription cancellation does not delete User Data. Project content remains stored while the account exists; work above the active plan limits may be frozen and read-only. Account deletion and a valid erasure request are separate from subscription cancellation. When an account-deletion or erasure request is completed, AgroForest Designer deletes or anonymises User Data, subject to limited backup retention and any legal or security obligation that requires specific records to be kept.

5. Commercial and acceptable use

Users may use the Service commercially, including to create agroforestry plans for clients as part of landscape design, advisory, educational, or consultancy work. Commercial use does not transfer ownership of the Service, its software, or the plant database.

The User may not:

  • Use the Service for unlawful, fraudulent, or harmful purposes.
  • Copy, scrape, download, or redistribute the plant database as a whole except where applicable law or a source licence permits it.
  • Abuse an API, bypass access controls or plan limits, or interfere with normal operation.
  • Upload or distribute malware, viruses, or other harmful code.
  • Attempt to gain unauthorised access to accounts, data, or systems.
  • Use the Service in a way that infringes the rights of another person.

6. Disclaimers and liability

Plant, food, and design information

AgroForest Designer is a planning aid and is not a substitute for advice from a qualified agronomist, landscape architect, engineer, medical professional, or other relevant expert. Plant information about medicinal use, edibility, nutrition, toxicity, compatibility, site suitability, and design risk is provided for informational purposes. The User is responsible for verifying that information before acting on it.

External sources and services

The Service contains information compiled from external scientific and open-data sources. AgroForest Designer does not guarantee that external information is complete, current, or error-free.

Map and location functionality may rely on Google Maps or other third-party services. AgroForest Designer is not responsible for interruptions, inaccuracies, unavailability, or data errors caused by those services.

Availability

No specific uptime percentage or service level is guaranteed. The Service is provided on an “as is” and “as available” basis, and maintenance or interruptions may occur. To the maximum extent permitted by applicable law, AgroForest Designer is not liable for indirect or consequential loss arising from use of or inability to use the Service.

7. Privacy and data protection

AgroForest Designer processes personal data in accordance with applicable data-protection law, including the GDPR where it applies. The privacy policy explains what data is collected, why it is processed, how long it is retained, which service providers receive it, and how a User can exercise data-protection rights.

8. Changes and termination

Changes to these terms

AgroForest Designer may update these terms to reflect changes to the Service, business practices, or legal requirements. Material changes will be communicated by email or through a notice in the Service. The updated version and date will be published on this page.

By the User

The User may cancel a paid subscription through the billing settings. The effective date is shown in the Stripe confirmation and in the account. Cancelling a subscription does not itself delete the account or User Data. Account-deletion and data-erasure requests can be sent to contact@agroforestdesigner.com.

By AgroForest Designer

  • An account may be suspended or terminated if the User materially breaches these terms.
  • An account may be terminated immediately where this is reasonably necessary to address fraud, illegal activity, or a serious security risk.
  • The Service may be discontinued with at least 30 days’ notice where reasonably possible.
