General Terms and Conditions
AgroForest Designer
SaaS Platform for Agroforestry Planning
1. Introduction
These General Terms and Conditions govern the legal relationship between AgroForest Designer (hereinafter: "the Service") and the user of the platform (hereinafter: "User"). By registering and using the Service, the User agrees to these terms and conditions.
AgroForest Designer is a web-based SaaS application for designing agroforestry plans with integrated plant management and interactive map visualisation.
2. Definitions
- Service: the web-based SaaS application AgroForest Designer, including all associated features
- User: the natural or legal person who registers and uses the Service
- Subscription: a paid or free membership with certain features and limits
- User Data: all information that the User enters into the Service, including projects, recipes and customised cultivars.
3. Registration and Account
3.1 Requirements
- The User must be at least 18 years old or have consent from their legal representative
- The User guarantees that the information provided is complete and accurate
- The User is responsible for keeping their password confidential
3.2 Multi-Account Policy
Users may create multiple accounts. These must, however, belong to the same person/organisation and cannot be used for fraud or violation of these terms and conditions.
4. Subscriptions and Pricing
4.1 Subscription Tiers
AgroForest Designer offers four subscription levels:
- Free Plan: 3 projects, 5 recipes, 10 cultivars, basic features
- Starter Plan: 5 projects, 10 recipes, 20 cultivars, basic features
- Pro Plan: 25 projects, 50 recipes, 100 cultivars, advanced features
- Max Plan: unlimited number of projects/recipes/cultivars, advanced features
Advanced features include: offline export, export of technical drawings, 3D visualisation, planting history, etc.
5. Payment and Auto-Renewal
5.1 Payment Methods
Payments for paid subscriptions are processed via Stripe, a trusted payment provider. The User must provide valid payment information.
5.2 Auto-Renewal
- Paid subscriptions automatically renew at the end of the payment period
- The User receives a reminder before auto-renewal takes place
- Cancellation can take place at any time via account settings; the subscription ends at the end of the current payment period
5.3 Refund Policy
AgroForest Designer does not issue automatic refunds following cancellation. For complaints or technical issues, valid refund requests can be submitted via contact@agroforestdesigner.com. Each case will be assessed individually.
6. Features and Limits
6.1 Limit Management
Each subscription offers limits on the number of projects, recipes and cultivars. When these limits are reached, the User can no longer create new items.
6.2 Downgrade and Freezing
When a User downgrades their subscription, items that fall outside the new limit are placed in a "frozen" state. These items remain visible but cannot be edited until the User upgrades again.
6.3 Upgrade Promotional Message
When a User approaches or reaches limits, the Service automatically displays upgrade recommendations with direct links to subscription options.
7. Ownership and User Data
7.1 Plant Database
The plant database is compiled from open sources. These sources are covered by the Creative Commons Licence (CC-BY-SA). The User may use this data for personal and commercial use of the Service, but may not copy or redistribute the entire database as a whole.
7.2 User Data
- Ownership: All projects, plant plans and custom plant combinations (recipes) created by the User are owned by the User
- Analytical Purposes: AgroForest Designer may use anonymised User data for analytical and research purposes without identifying the User
7.3 Export and Offline Use
- Users of the Pro and Max plans can download their projects and store them locally
- Free and Starter users do not have the option to export offline
8. Data Retention Following Cancellation
Following cancellation or deletion of the account, User Data remains available to the User during the payment period. Thereafter, data is deleted in accordance with European GDPR guidelines. AgroForest Designer will provide the User with sufficient time to export data before permanent deletion takes place.
9. Commercial Use
Users may use the Service for commercial purposes, including creating agroforestry plans for clients as part of landscape design, advisory or consultancy services. This use is permitted under all subscription levels.
10. Prohibited Activities
- The User may not use the Service for unlawful purposes
- The User may not copy or download the plant database as a whole
- Automated scraping or API abuse is prohibited
- The User may not distribute viruses, malware or harmful code
- The User may not attempt to gain unauthorised access to the Service
11. Disclaimers and Liability
11.1 Plant Medicine and Nutrition
AgroForest Designer is not a substitute for professional advice from qualified agronomists, landscape architects or other experts. Information about medicinal applications, edibility, nutritional value and toxicity of plants is for informational purposes only. The User is wholly responsible for verifying and using plant-related information. AgroForest Designer accepts no liability for:
- Plant toxicity or poisonous effects
- Medicinal or medical claims
- Nutritional value or food safety
- Plant guilds or botanical compatibility
- Design or structural risks
11.2 External Sources
The plant database contains data from various scientific sources. AgroForest Designer accepts no liability for inaccuracies, outdated information or errors in these sources.
11.3 Google Maps Integration
AgroForest Designer uses Google Maps for map functionality. AgroForest Designer is not liable for disruptions, inaccuracies, unavailability or data errors in Google Maps.
11.4 No Service Level Agreement
AgroForest Designer guarantees no specific uptime percentage or availability level. The Service is provided in an "as-is" condition. Service interruptions may occur without prior notice.
12. Data Protection (GDPR)
AgroForest Designer processes personal data in accordance with the European GDPR regulation. For more information, please refer to our separate Privacy Policy. The User has the right to access, rectify and delete personal data via account settings or by contacting contact@agroforestdesigner.com.
13. Changes to the Terms and Conditions
AgroForest Designer reserves the right to amend these General Terms and Conditions at any time. Changes will be announced via email and through the Service. Continued use of the Service following changes constitutes acceptance of the amended terms and conditions.
14. Termination
14.1 By User
The User may cancel the account at any time via account settings. The subscription ends at the end of the current payment period.
14.2 By AgroForest Designer
- AgroForest Designer may terminate the account in the event of breach of these terms and conditions
- AgroForest Designer may discontinue the Service entirely with 30 days' prior notice
- In the event of fraud or illegal activities, the account may be terminated immediately without notice

16. Final Provision
These General Terms and Conditions constitute the entire agreement between AgroForest Designer and the User. The invalidity of any one provision does not affect the validity of the other provisions.
